Условия использования

First Line Support («First Line», «мы») владеет и управляет веб-сайтом с доменным именем https://stfirstpay.com, предназначенным для помощи пользователям в пополнении их Steam-аккаунта.

Настоящие Условия и положения вместе с действующей Политикой конфиденциальности и другими документами First Line определяют правовые отношения между First Line и пользователями Платформы.

1. Определения

Аккаунт – аккаунт, который предоставляет Пользователю возможность использовать Услуги, предоставляемые на Платформе, и получать все связанные с этим преимущества.

Платформа – данная платформа, доступная в сети Интернет по адресу: https://stfirstpay.com.

Услуга – одна из услуг, предоставляемых First Line, как описано в настоящих Условиях.

Условия и положения – данный свод правил, определяющий права и обязанности Пользователей, Продавцов и First Line, а также условия использования Платформы.

Пользователь – физическое лицо, действующее в рамках данных Условий в целях, не связанных с его торговлей, бизнесом, ремеслом или профессией (т.е. как потребитель), зарегистрировавшее Аккаунт на Платформе и/или намеревающееся пополнить свой Steam-аккаунт.

2. Применимость настоящих Условий

First Line и Пользователь соглашаются с настоящими Условиями в полном объеме и без каких-либо оговорок. Во избежание сомнений, данные Условия также применяются к анонимным пользователям, которые заходят на Платформу, и, зайдя, такие лица принимают настоящие Условия, Уведомление о конфиденциальности и любые другие документы Платформы.

Пользователи, которым запрещено использовать Платформу в связи с законодательством их государства или региональными ограничениями, включая страну/регион текущего проживания Пользователя и место использования услуг, обязаны воздержаться от использования Платформы.

Каждый Пользователь подтверждает, что ему исполнилось не менее 18 (восемнадцати) лет или он достиг возраста, установленного законодательством соответствующей страны, который позволяет брать на себя обязательства, вытекающие из договорных отношений, и обладает полной дееспособностью. Также каждый Пользователь подтверждает, что в соответствии с законодательством его страны у него нет ограничений на использование Услуг, предоставляемых First Line.

First Line взаимодействует с Пользователями посредством отправки электронных писем, через электронную систему Аккаунта на Платформе, оставляя уведомления, или посредством уведомлений через каналы связи в других сервисах. Пользователи и Продавцы безоговорочно соглашаются получать электронные уведомления и соглашаются, что все соглашения, уведомления, раскрытия информации и другие сообщения, предоставляемые First Line в электронном виде, соответствуют юридическим требованиям, предъявляемым к такому общению в письменной форме.

3. Условия использования

В соответствии с настоящими Условиями и положениями, First Line предоставляет Пользователям ограниченную, неисключительную, непередаваемую и несублицензируемую лицензию на доступ и использование Услуг First Line исключительно в личных и некоммерческих целях.

Пользователи обязаны не злоупотреблять Услугами First Line и использовать их только в соответствии с законодательством и настоящими Условиями. Неправомерное использование Услуг может нанести ущерб First Line или третьим лицам.

В случае нарушения Пользователями условий использования Услуг, они обязаны возместить весь причиненный ущерб.

Все права, прямо не предоставленные Пользователям в рамках настоящих Условий, сохраняются за First Line или их владельцами, лицензиарами, поставщиками, издателями или другими уполномоченными лицами.

Объекты интеллектуальной собственности, такие как тексты, графические материалы, интерактивные функции, логотипы, фотографии, файлы, программное обеспечение на Платформе, являются интеллектуальной собственностью First Line. Они защищены авторскими правами, товарными знаками, патентами, правами на промышленные образцы и другими правами и положениями, включая международные конвенции и имущественные права. Все такие права сохраняются за First Line. Любые товарные знаки, обозначения и торговые названия являются собственностью First Line.

Без письменного согласия First Line Пользователям запрещено дублировать, копировать, скачивать, распространять, продавать, распространять или перепродавать любые услуги, информацию, тексты, графику, видеоклипы, звуки, сценарии, файлы, базы данных или списки, доступные на Платформе или через нее, а также использовать их любым иным образом. Запрещается систематически извлекать контент Платформы для создания или составления, прямо или косвенно, коллекции, компиляции, базы данных и каталога (с использованием роботов, поисковых систем, автоматических или ручных устройств) без явного письменного разрешения First Line. Использование любых материалов или контента, доступных на Платформе, для целей, не указанных в Условиях, строго запрещено, включая использование, публикацию, копирование в любой форме – электронной, механической, фотографической или другой (Все права защищены).

First Line вправе предоставлять Пользователям гиперссылки на Платформе (например, баннеры, каналы) с доступом к контенту, продуктам или услугам, предлагаемым другими поставщиками, ведущие на сайты таких поставщиков. First Line не несет ответственности за достоверность, точность или надежность информации, представленной указанными поставщиками. First Line рекомендует изучить все документы на сайтах таких поставщиков. Пользователи признают, что First Line не контролирует действия этих поставщиков.

Пользователи подтверждают и заявляют, что они:

• не будут загружать или распространять на Платформе информацию, которая может нарушать законы, договорные обязательства или права третьих лиц, включая материалы, защищенные авторским правом, личные данные, коммерческие тайны и т.д.;
• не будут выдавать себя за других лиц или организации (существующих или вымышленных), ложно утверждать о своей связи с другими лицами или организациями, получать доступ к чужим Аккаунтам или предоставлять ложную информацию, вводящую в заблуждение First Line или других Пользователей;
• не будут пытаться взломать, модифицировать, отключать или иным образом воздействовать на Платформу или нарушать ее безопасность;
• не будут использовать Платформу для других целей, кроме тех, для которых предназначены Услуги First Line;
• не будут пытаться собирать личные данные, хранящиеся в системе Платформы, без согласия субъектов данных, а также оскорблять или вводить в заблуждение других Пользователей или Продавцов;
• не будут использовать Платформу в незаконных целях или нарушать законы, включая положения о защите авторских прав, интеллектуальной собственности и других имущественных прав;
• не будут препятствовать деятельности Платформы или создавать трудности другим Пользователям в ее использовании;
• не будут проводить транзакции с использованием денег из незаконных или нераскрытых источников.

4. Ответственность

Ответственность First Line исключается в отношении:

• Пользователей, действия которых находятся за пределами контроля First Line и приводят к ущербу (например, нарушение Условий, Уведомления о конфиденциальности, применимого законодательства, предоставление доступа к Аккаунту другим лицам или другие действия);
• любых неблагоприятных последствий, связанных с доступом, использованием или невозможностью использования Платформы по причинам, находящимся вне контроля First Line;
• любых действий First Line в отношении Пользователей или Продавцов, связанных с нарушением Условий или применимого законодательства, включая приостановку или прекращение действия Аккаунтов, ограничение функциональности Платформы;
• последствий несанкционированного доступа третьих лиц к данным, если First Line своевременно принял разумные меры для предотвращения последствий, а также если ущерб связан с действиями или бездействием Пользователей;
• любых последствий, вызванных вирусами, троянами и другими угрозами, переданными третьими лицами через Платформу, за исключением случаев, когда First Line принял все доступные меры для их устранения;
• нарушения законов или прав третьих лиц Продавцами, в частности, ущерба третьим лицам, вызванного нарушением авторских или промышленных прав, или технических проблем при завершении транзакций;
• предоставления Пользователями ложной информации, заявлений, гарантий или данных, указанных в Условиях, Уведомлении о конфиденциальности и других документах Платформы;
• любого ущерба, вызванного Пользователями из-за ненадлежащего выполнения ими Условий, Уведомления о конфиденциальности или других документов Платформы.

First Line отказывается от любых гарантий, включая гарантии условий, пригодности, качества или функционирования услуг, доступных на Платформе. First Line несет ответственность только за надлежащую доступность Услуг. В максимальной степени, разрешенной законом, все услуги, предоставляемые First Line через Платформу, доступны “КАК ЕСТЬ”, “ЕСЛИ ДОСТУПНЫ” и “СО ВСЕМИ ДЕФЕКТАМИ”, и First Line прямо отказывается от всех гарантий.

Каждый Пользователь обязуется полностью возмещать убытки, защищать и ограждать First Line от всех претензий, исков, убытков, обязательств, затрат и расходов (включая, но не ограничиваясь, разумными юридическими расходами), возникших в результате:

• нарушения Пользователем своих обязательств по Условиям;
• нарушения законодательства или прав третьих лиц (включая интеллектуальную собственность);
• любых претензий, связанных с аукционом или транзакцией, размещенной Пользователем или First Line от имени Пользователя.

Пользователь обязан уведомить First Line в письменной форме о любой претензии или иске и сотрудничать в их урегулировании. Пользователь не имеет права заключать мировое соглашение без согласия First Line.

First Line Support (“First Line”, “we”, “us”) possesses an operates website with the domain name https://stfirstpay.com designed to help the user to top-up their Steam account. 

These Terms and Conditions together with the applicable Privacy Policy and other First Line Support’s documentation define legal relations between First Line and users of the Platform.

1. Definitions

Account – an account which gives a possibility for the User to use Services provided in the Platform and get all of the benefits from it.

Platform – this platform which is made available on the Internet under the address: https://stfirstpay.com

Service – one of the services which are provided by First Line as described in these Terms and Conditions.

Terms and Conditions – this set of rules that determines the rights and obligations of Users, Vendors and FIRST LINE and the terms regulating the use of the Platform.

User – a natural person who acts in relation to these Terms and Conditions for the purposes other than their trade, business, craft, or profession (i.e., consumer), and has registered an Account on the Platform and (or) has an intention to top up its Steam account

• Applicability of these Terms and Conditions

First Line and the User hereby agree to and accept these Terms and Conditions in its entirety and without any reservations.

For avoidance of doubt, these Terms and Conditions are also applicable to any anonymous users that enter the Platform and by entering, such persons accept these Terms and Conditions, Privacy Notice and any other Platform’s documentation.

Users who are prohibited from using the Platform due to regulations of the respective state or regional restrictions, including the country/region of current residence of the User and place of use of services, are hereby asked to refrain from using the Platform.

Each User confirms that they are at least 18 (eighteen) years old or have reached the age under respective country’s laws which allows them to assume responsibility for obligations emerging from contractual relations and has a full capacity to take legal actions. Also, each User confirms that there are no restrictions under respective country’s laws for them to use Services provided by First Line.

First Line communicates with Users by sending e-mails, through the Platform Account’s electronic system by leaving notices to them, or through distribution of notices via communication channels within other services. Users and Vendors unconditionally consent to receive communications electronically and agree that all agreements, notices, disclosures and other communications that First Line electronically provides shall meet any legal requirements of such communication in writing.

• Terms and Conditions of Use

In accordance with these Terms and Conditions, First Line grants Users a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Services provided by First Line.

Users are bound not to abuse First Line Services and only use it as it is established by law and these Terms and Conditions. Inappropriate use of Services could cause negative effects to First Line or third persons and if Users violate the terms of use of Services, they are responsible for eliminating all caused damage.

All rights not expressly granted to the Users in these Terms and Conditions are reserved and retained by First Line or their owners, licensors, suppliers, publishers or other authorized persons.

Any intellectual property objects such as any texts, graphic materials, interactive functions, logos, photographs, files, software on the Platform constitute intellectual property of First Line. They are protected by copyrights, trademarks, patents, industrial design rights and any other rights and provisions, including international conventions and property rights. Any such rights are reserved for First Line. Any trademarks, marks and trade names constitute First Line property.

Unless with written express First Line consent, Users are not allowed to: duplicate, copy, download, disseminate, sell, distribute or resell any services, information, texts, graphics, video clips, sounds, screenplays, files, databases or lists whatsoever available on or via the Platform nor use them otherwise. It is forbidden to retrieve the Platform content systematically to create or compile, either directly or indirectly, a collection, compilation, database and catalogue (by using robots, search engines, automatic or manual devices) without express written permission of First Line. The use of any content or materials available on the Platform for purposes not specified in the Terms and Conditions is prohibited, especially any use, publication, copying in any form – whether electronic, mechanic, photographic or other (All Rights Reserved).

First Line is allowed to provide Users hyperlinks on the Platform (i.e., banners, channels) with access to the content, products or services offered by other providers leading them to the websites of such providers. First Line is not liable for the certainty, accuracy or trustworthiness of information submitted by mentioned providers. First Line recommends reading all documents on sites of such providers. Users acknowledge that First Line has no control of these providers actions.

Users confirm and state that they:

• will not upload or spread any information on the Platform which could violate laws, contractual agreements or third persons’ rights. Such potentially sensitive information could be copyrighted material, personal data, trade secrets and other;

• will not impersonate another person or entity, whether existing or fictional, or falsely maintain to be related to any other person or entity, nor access other User’s or Accounts, nor provide any false information which could mislead First Line, other Users;

• will not attempt to hack, modify, disable or affect in any other way the Platform or challenge its security;

• will not use the Platform for any other purposes than as it is intended to be used considering the purposes of First Line Services ;

• will not try to collect any personal data which is being held at the Platform system without the consent of particular data subject and will not offend or deceive other Users or Vendors;

• will not use the Platform for any illegal purposes or for violating any laws, including provisions relating to copyright, intellectual property rights and other property rights protection;

• will not try to interfere with the Platform’s activity or prohibit other Users from using the Platform (or making it difficult to use);

• will not make transactions with money from illegal or undisclosed sources.

• Liability

First Line’s liability is excluded in relation to:

• Users acting beyond First Line’s control and resulting in dealing damage (i.e., violated Terms and Conditions, Privacy Notice, applicable laws, provided access to the Account to another person or performed other actions);
• any adverse consequences resulting from access, use of or inability to use the Platform due to reasons beyond FIRST LINE control;
• any actions taken by FIRST LINE in relation to Users or Vendors related to infringement of these Terms and Conditions or applicable laws. Such include suspending or terminating Accounts or limiting functionality of the Platform;
• implications of any access to data and information being reached by third persons in an unauthorised way which was not possible to track in time, unless FIRST LINE did not take reasonable actions as soon as possible to prevent the consequences, also where any adverse consequences to private data occur subject to actions and omissions of Users;
• any adverse consequences due to viruses, trojan horses etc. which may be transferred to the Platform or through the Platform by third parties, except that FIRST LINE shall ensure that all the reasonably available measures are taken to remove such threats;

• laws or any third-party rights infringed by Vendors, in particular in relation to any damages caused to third parties by Users  as a result of violating copyrights, industrial property rights, transaction of purchase being not completed because of the technical problems in one of the proposed payment methods on the Platform;

• Users submitting false or untrue statements, information, assurances and data subject to the Terms and Conditions, Privacy Notice and any other Platform’s documentation;

any form of damage caused by Users because of their non-performance or improper performance of Terms and Conditions, Privacy Notice or other documents of the Platform, as well as any rights and obligations towards each other.

FIRST LINE declines all guarantees that consist of condition, suitability, quality or functioning warranties related to the services available on the Platform. FIRST LINE is only liable for proper availability of using Services.

To the fullest extent permitted by law, all services provided by FIRST LINE on or via the Platform are made available on an AS IS, IF AVAILABLE, and WITH ALL DEFECTS basis, and FIRST LINE hereby expressly declines all warranties.

Each User shall fully indemnify, hold harmless and defend from and against all claims, demands, actions, suits, damages, liabilities, losses, settlements, judgments, costs and expenses (including but not limited to reasonable attorney’s fees and costs), which arise out of or relate to (i) any breach of any representation or warranty of the User contained in these Terms and Conditions, (ii) any breach or violation of any covenant or other obligation or duty of the User under these Terms and Conditions or under applicable law, (iii) any alleged breach or violate by the User of third party rights, including intellectual property rights, (v) any claim related to the auction or transaction listed by the User, or listed by FIRST LINE on behalf of the User in each case whether or not caused by the negligence of the User or any other Indemnified Party and whether or not the relevant claim has merit.

Each User shall inform FIRST LINE in writing of any claim, demand or suit and shall fully cooperate in the defence thereof. No User will agree to the settlement of any such claim, demand or suit prior to the final judgment thereon without the consent of FIRST LINE whose consent may be withheld at FIRST LINE sole and entire discretion.

Unless the applicable law provides otherwise, FIRST LINE is entitled to make, at its absolute discretion, any set-off from funds accumulated by any User.
